Terms of Service

These Terms govern your use of peakhour.app (the "Site") and any services we provide through it. The PeakHour macOS application itself is licensed under the End User License Agreement; these Terms supplement, but do not replace, that license.

Who we are

The Site is operated by Digitician Inc. ("we", "us"). You can reach us at [email protected].

Acceptable use

You agree not to:

• Use the Site to violate any law or another party's rights.
• Probe, scan, or attempt to breach the Site's security beyond what we authorize via a written disclosure programme.
• Scrape the Site at a rate that interferes with legitimate access, or to build a competing product.
• Misrepresent your identity in correspondence with us.

Intellectual property

The Site's content, design, and trademarks belong to Digitician Inc. or its licensors. You may link to the Site and quote short excerpts with attribution; you may not reproduce the Site or claim association with PeakHour without our written permission.

Purchases & refunds

PeakHour is distributed through the Mac App Store. Purchases, subscriptions, and refunds are handled by Apple under Apple's terms. See our purchase support page for how to request a refund through Apple.

Third-party links

The Site links to third-party services (App Store, Apple's privacy policy, Cloudflare, and others). We don't control those services and aren't responsible for their content or practices.

Disclaimers

The Site is provided "as is". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, Digitician Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. Nothing in these Terms limits liability that cannot be limited by law.

Changes

We may update these Terms. When we do, the "last updated" date above changes. Continued use of the Site after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws applicable to Digitician Inc.'s place of incorporation. If you have a complaint, please contact us first — we'll usually be able to resolve it without escalation.
